These Terms of Service ("Terms") govern your access to and use of Skypod. By creating an account or using the service, you agree to these Terms. Please read them carefully.
1. User accounts
To use Skypod you must create an account and provide accurate, current information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission.
2. Acceptable use
You agree not to use Skypod to:
- Upload content that is unlawful, harassing, abusive, or violates anyone's privacy.
- Infringe any intellectual property or other rights of third parties.
- Distribute malware, spam, or attempt to disrupt the service.
- Attempt to access accounts, pods, or data that don't belong to you.
- Reverse engineer, scrape, or misuse the service beyond its intended purpose.
3. User-generated content
You retain full ownership of the photos, videos, voice notes, and messages you upload to Skypod ("User Content"). You grant Skypod a limited, worldwide license to host, store, transmit, and deliver your User Content for the sole purpose of providing the service to you and your designated recipients.
You are responsible for the User Content you upload and for ensuring you have the right to upload it.
4. Ownership
All rights, title, and interest in Skypod — including the software, design, brand, and underlying technology — remain the property of Skypod and its licensors. These Terms do not transfer any ownership of the service to you.
5. Platform availability
We work hard to keep Skypod available, but we do not guarantee uninterrupted service. Maintenance, updates, third-party outages, and unforeseen events may temporarily affect availability. We are not liable for downtime, though we'll communicate clearly when it occurs.
6. Intellectual property
The Skypod name, logo, copy, and design are protected by trademark and copyright laws. You may not use them without our written permission, except as necessary to identify the service when referring to it accurately.
7. Limitation of liability
To the maximum extent permitted by law, Skypod and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill arising out of your use of the service.
Skypod's total liability for any claim arising out of or relating to these Terms will not exceed the greater of one hundred U.S. dollars or the amount you paid Skypod in the twelve months preceding the claim.
8. Account termination
You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or that pose a risk to other users or to the integrity of the service. Where reasonable, we'll give you notice and a chance to fix the issue.
On termination, your account access ends and your User Content will be removed from active systems on a routine schedule, unless we are required by law to retain it.
9. Changes to the service or Terms
Skypod evolves over time, and these Terms may evolve with it. We'll provide reasonable notice of material changes by email or in-product notification. Continued use of the service after changes take effect constitutes acceptance.
10. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, unless required otherwise by applicable law.
